Α. Terms of Use

Please read the following Terms of Use carefully before using this website. Visiting / using the Open Data Hub website constitutes unconditional acceptance of these Terms of Use. 

Navigating and remaining on the Open Data Hub website, as well as viewing or using the datasets or APIs related to the datasets, constitutes practical acceptance of these Terms of Use.

You declare that you have full capacity and authority to accept these Terms of Use. If you are accepting them on behalf of your employer or another entity, you declare that you are legally authorized to bind your employer or the entity.

  1. Definitions

The Open Data Hub website is owned by the Hellenic Corporation of Assets and Participations S.A. (hereinafter referred to as the “HCAP” or “We” or “Us”).

The Open Data Hub website, through technologically advanced web infrastructures and open-source software applications, offers to everyone (hereinafter, “user/visitor”) search, access and further use of open data and datasets under these Terms of Use.

“Open Data”: Data that can be freely used, reused, and redistributed by anyone – provided they are made available in turn under the same terms.

“Dataset”: Data organized in collections, managed by Growthfund and its subsidiary companies.

  1. Use of the Open Data Hub

Access to the Open Data Hub is free for any interested user/visitor.

Use of the Open Data Hub must be solely for lawful purposes and in a manner that does not restrict or prevent its use by third parties. The user/visitor must use the Open Data Hub in accordance with the law and these Terms of Use. The user/visitor of the Open Data Hub must not perform any acts or omissions that may cause damage to or malfunction of the Open Data Hub.

  1. Licenses

You are encouraged to use the open data/datasets creatively for your benefit and for the benefit of others.

You may export, download, and copy the data, share, redistribute, and reuse it, etc., in accordance with these Terms of Use.

Unless otherwise specified in the dataset, the datasets provided by the Open Data Hub are made available under the Creative Commons Attribution (CC BY v. 4.0) license, in combination with these additional Terms. In any case, you can find out in detail about the conditions of the licence that accompanies each dataset by selecting the dataset itself.

You agree to provide attribution in the following manner [suggested citation format: Growthfund_Open Data Hub, name of the Dataset, data source, under CC BY v. 4.0 or the applicable license mentioned in the dataset].

  1. Third-Party Data and Websites

Some datasets may be provided by third parties and may not be redistributed or reused without the original provider’s consent or may be subject to different terms from those described here.

Additionally, the Open Data Hub may contain links (hyperlinks) to third-party websites. The reference, by means of links, to third party websites does not constitute an endorsement or acceptance of the views, actions and content of third parties. The third parties are solely responsible for the content of their websites or for any damage that may arise from the use of these websites when the user/visitor of the Open Data Hub accesses them. By visiting third-party websites, the user/visitor acknowledges that is leaving the Open Data Hub site and is subject to the third party’s terms of use and privacy policy.

  1. Independent Parties

You are not permitted to publicly state or imply that we have endorsed the way or purpose for which you use or reproduce the data.

Anything provided to you via the Open Data Hub does not, directly or indirectly, constitute an incentive, advice, or recommendation to perform any act. It is your sole discretion to evaluate what is provided and act upon your own free will, with no liability on our part.

  1. Intellectual property rights (i.e., copyright and industrial property rights)

You may not use the name, trademarks, emblems, or logos of Growthfund and its subsidiaries, as well as those of the Open Data Hub, without our prior written consent.

The content of the Open Data Hub — including but not limited to graphics, images, videos, texts — is intellectual property of Growthfund, its subsidiaries, or their suppliers/partners and is protected by Greek and international intellectual property laws. Any copying, reproduction, transmission, storage, alteration, republication, distribution, publication, performance, download, translation, modification in any way, communication, dissemination, or any other use of such Open Data Hub content that incorporates intellectual property rights and does not constitute Open Data (subject to the provisions of the relevant licence) in any manner or by any means, for commercial or other purposes, is prohibited without the express prior written consent of the relevant rights holder.

Any content protected under Law 2121/1993 or other relevant legislation, which is identified as the intellectual property of third parties (and not of Growthfund or its subsidiaries or suppliers/partners), is not covered by the Open Data license or any other license. To use or exploit content owned by third parties, the end user must contact the holders of the relevant intellectual property rights to obtain the necessary licenses for use and exploitation.

The appearance and display of all the above data on the Open Data Hub website should in no way be interpreted as granting or assigning a license or right to use them. Any violation of intellectual or industrial property rights in any way may lead to legal consequences as defined by law.

  1. Liability

We make every effort to ensure that the information and content displayed on the Open Data Hub are as accurate, truthful, and up to date as possible.

Each dataset and the data in a dataset, the rest of the content (e.g., names, images, illustrations, etc.) and services made available through the Open Data Hub, are provided as is.

We are not liable for any loss or damage of any kind that you may suffer related to your use of the datasets or from an inability to access information or services due to system issues (software, hardware, etc.).

We bear no responsibility for the accuracy, usefulness, or availability of the data in the datasets.

  1. Disputes

In the event of any disputes arising in relation to the present terms, if they cannot be resolved amicably, the courts of the city of Athens shall have jurisdiction.

  1. Privacy

The Open Data Hub does not collect information from you, such as your internet address from which you access this website, or the date and time of access.

Users/visitors are not required to provide any information to view, search, retrieve, and/or download a dataset. Creating an account is not required to download a dataset.

Growthfund respects the personal data of users/visitors of this website. The management and protection of users’/visitors’ personal data on the Open Data Hub are subject to the terms of the applicable data protection laws, in particular the General Data Protection Regulation (EU) 2016/679 (GDPR) and Greek Law 4624/2019.   1. Cookies

This website uses cookies to identify its users/visitors.

Cookies are small text files that are stored on the hard drive of each user/visitor without causing any damage to their computer or other device with internet access, nor to the files stored on those devices. Cookies perform various functions (for example, they distinguish you from other users/visitors of the same website or remember certain things about you, such as your preferences) and are used to improve your experience.

  1. Other Terms

We reserve the right to modify or discontinue, temporarily or permanently, the operation of the Open Data Hub at any time, as well as to modify the Terms of Use, datasets, any means of accessing or using the datasets, or the API, at our discretion.

We make every effort to ensure the proper operation of our network, however we do not guarantee that the operations of our servers will be uninterrupted or free from any kind of errors, viruses, malware or other similar components. Therefore, we are not liable for any damage that may be caused, including but not limited to, to users’ equipment, software, or files.

By continuing to use the datasets after an amended version of these Terms of Use, you acknowledge, agree and consent to such modification.

If any term herein is held invalid, it shall automatically cease to apply either in its entirety or to the extent deemed invalid and shall either be removed from these Terms or modified to be valid, while the remaining terms shall remain in full force and effect.

These Terms of Use are governed by Greek law. The Terms of Use are further supplemented by national law, EU law, and relevant international treaties.

Β. Privacy Policy

  1. General

The use of the Open Data Hub by the user/visitor, which belongs to the Hellenic Corporation of Assets and Participations S.A. (or “Growthfund” or “We” or “Us” or other first-person plural references), requires your unreserved agreement with the Privacy Policy regarding the protection of personal data on this website.

HCAP is a société anonyme (S.A.) established under Law 4389/2016, registered with the General Commercial Registry (G.E.MI.) under number 140358160000, with the following contact details: Tel.: +30 210 0106900, Fax: +30 210 0106953, Email: contact@www.growthfund.gr, Website: https://www.growthfund.gr/. Growthfund and/or its subsidiaries act as the Data Controller to the extent they process personal data. The use of the first person plural where applicable may mean (and) the subsidiaries of Growthfund.

This Privacy Policy explains the purposes for which we process your personal data, how we collect, manage, and protect the personal data provided by you, how such information is used and what rights you have regarding your personal data. It also includes the contact details of the Data Controller and the Data Protection Officer.

Therefore, the user/visitor must carefully read the contents of this page before using the Open Data Hub. If you do not agree, you must leave the Open Data Hub website and refrain from using its services and content.

This Privacy Policy may be revised from time to time in accordance with amendments to relevant legislation. You are advised to check this page occasionally for any changes to the Privacy Policy. Continued use of the Open Data Hub following any changes to the Privacy Policy indicates your unconditional acceptance of those changes. The version in force is always the most recently amended version of the Privacy Policy.

The management and protection of personal data by Growthfund are subject to the terms of the applicable data protection legislation, particularly the General Data Protection Regulation (EU) 2016/679 (GDPR) and Law 4624/2019.

If you are a minor, it is necessary to have the consent of your parent or guardian before using the Open Data Hub.

We take all appropriate technical and organizational security measures, which we periodically review, and apply technological standards in accordance with applicable laws and regulations, to ensure the safe and proper use and integrity of the personal data we collect, and to prevent unauthorized or accidental access, processing, deletion, alteration, or any other use.

  1. Open Data Hub collects the following personal data for the following purposes:

We collect and process your personal data only when absolutely necessary and only those you disclose to us during your browsing on the Open Data Hub website.

  • Contact Forms

If you choose to fill out one of the contact forms on the Open Data Hub, the personal data you provide will be processed (collected, organized, stored, etc.) by Growthfund and/or a designated subsidiary.

When filling out the Open Data Hub contact form, you provide us with the following personal data (those with * are mandatory fields):

  • Informational Purposes

We use your personal data for informational purposes or to send announcements/news via email to users/visitors of the Open Data Hub.

  1. Legal Basis for Processing Personal Data

1. You, as the data subject, have consented to the processing of your personal data for one or more specific purposes.

2. Processing is necessary for compliance with a legal obligation to which the Data Controller, Growthfund or one of its subsidiaries, is subject.

3. Processing is necessary for the purposes of the legitimate interests pursued by the Data Controller, Growthfund or a designated subsidiary. 

Growthfund does not generally request users/visitors to provide personal data about another individual. However, if such data must be provided, users/visitors must ensure that: (a) the individual concerned has been informed about the contents of this Policy, and (b) they have obtained the individual’s explicit consent to share their data with Growthfund in accordance with this Policy, where required, or as may otherwise be required by applicable law.

  1. Processing Method

Personal data is stored on servers located within the EU.

Exclusive access to your personal data is granted to the competent bodies and employees of the Growthfund (HCAP), who are bound by a confidentiality obligation, or to its subsidiaries, where necessary.

We safeguard the confidentiality of your personal data and do not disclose it to any third party, unless required by law and solely to the competent authorities.

Your personal data is retained for as long as required under the applicable legislation.

We take all necessary measures to retain the personal data we collect and process in accordance with this Policy for the period strictly necessary to fulfill the purposes for which it was collected, as well as to comply with any legal obligations or internal procedures, and for as long as required to protect our legal rights and interests, taking into account the applicable statute of limitations.

  1. Your Rights

Finally, in accordance with the applicable provisions of the GDPR (Articles 13–22) and Law 4624/2019, you have the following rights regarding the personal data concerning you, that we collect and process in accordance with this Policy:

(a) the right to obtain confirmation as to whether or not your personal data is being processed, and, if processed, to access the data and specific information related to the processing, as provided under the applicable provisions and subject to the conditions they establish.

(b) the right to request the correction of inaccurate data or the completion of incomplete data.

(c) the right to request the erasure of your personal data under certain conditions, as set forth in the applicable legislation.
Please note that in some cases, such as where processing is necessary for compliance with a legal obligation under EU or national law, or for the performance of a task carried out in the public interest, or for the establishment, exercise, or defence of legal claims, we may not be able to fulfil your deletion request.

(d) The right to request the restriction of processing of your data, in the cases provided by the applicable law. Please note that we may continue to process data subject to restricted processing for specific reasons outlined in the law, including the establishment, exercise, or defense of legal claims or for reasons of important public interest under EU or national law.

(e) The right to object, at any time and on grounds relating to your particular situation, to the processing of your personal data in accordance with the applicable law. In such cases, we will cease processing unless there are compelling legitimate grounds for the processing that override your interests or rights and freedoms, or for the establishment, exercise, or defense of legal claims.

(f) The right, where applicable and subject to conditions, to receive your personal data in a structured, commonly used, and machine-readable format, or to request the transmission of such data to another controller, in accordance with the applicable laws.

(g) The right to withdraw, where applicable, your consent at any time, where processing is based on your consent.
Please note that such withdrawal shall not affect the lawfulness of any processing carried out prior to the withdrawal.

Please also note the following:

(a) If we have reasonable doubts regarding your identity, we may request additional information to confirm it.

(b) We will make every effort to respond to your request without undue delay and, in any case, within one (1) month from the date of receipt. If necessary, this period may be extended by two (2) additional months, taking into account the complexity and number of requests. In such a case, we will inform you of the extension and the reasons for the delay within one (1) month from receiving your request.

(c) Responses to your requests are generally provided free of charge. However, if requests are manifestly unfounded or excessive—particularly due to their repetitive character—we may charge a reasonable fee or refuse to act on the request.

You also have the right to lodge a complaint with the Hellenic Data Protection Authority (www.dpa.gr), which is the competent supervisory authority for the protection of the fundamental rights and freedoms of individuals regarding the processing of their personal data.

Policy Updates & Governing Law

The Growthfund regularly reviews the content of its website and this Policy. The Growthfund reserves the right to modify the website content and this Policy at any time, without prior notice, by simply posting the updated content on this website.
For this reason, we encourage you to regularly review this Policy for any updates or changes.

This Policy, as well as the use of this website in general, is governed by Greek law. Any dispute that may arise shall fall under the jurisdiction of the courts of Athens.
